Permanent and portable pools are subject to the city's swimming pool code.
All pools, hot tubs and spas, in-ground or above-ground, that can be filled with water to a depth of 24 inches or more require a permit before installation. In-ground pools require a major home improvement permit, while above-ground pools (including portable ones) require a minor home improvement permit. A site plan showing the location of the pool must be submitted with the application. Pools must be behind required setbacks and outside easement areas. An electrical permit also is required if the pool apparatus includes a pump.
In addition, a fence or barrier at least 48 inches above grade is required for all pools, hot tubs and spas. If a fence is used as the barrier, gates must be self-closing and self-latching and must accommodate a locking device. If a wall of the house is used as part of the barrier, doors with access to the pool shall be equipped with an alarm. If an above-ground pool, the outside wall of the pool is 48 inches or more above grade, it can be used as the required barrier, as long as any ladder accessing the pool is removable or surrounded by a barrier that meets code.
