The Supreme Court of Ohio ruled Aug. 31 a referendum of a Liberty Township zoning decision won't be on the Nov. 8 ballot.

The Liberty Township residents that filed the referendum missed the 30 day deadline required by state law, the court said.

The residents filed the referendum on the trustees' decision to rezone 216 acres to allow 148 single-family lots on the southwest corner of Home Road and state Route 315.

The Edwards Land Co., the property's developer, objected to the referendum on several grounds including the late filing date, but the Delaware County Board of Elections certified the referendum for the Nov. 8 ballot anyway.
