The Upper Arlington Board of Zoning and Planning voted 6-0 Monday, June 18, to uphold a city staff decision that said Primrose Schools must seek a rezoning, not a conditional use permit,  in order to build a 12,000-square-foot day care facility on Tremont Road.

In March, Primrose, a national day care chain, submitted plans to the city to purchase property at 3426 Tremont Road near London Drive and construct a facility that would house 204 students.

Attorney Buck Mallory, representing Primrose, said he needed to confer Mallory with Primrose officials before a decision is made about filing an appeal with Upper Arlington City Council.
