Marysville City Administrator Terry Emery is back at work after a two-week, unpaid suspension for having an affair with the assistant finance director.

Emery's suspension, according to city documents, is for four weeks. Mayor John Gore decided, however, that having him out of the office for that much time would create a hardship, so he was back on the job last week and this week, although the record reflects the full suspension as discipline.

Nancy Myers, whose primary job is income-tax administrator, received a two-week suspension (although only a week of it was without pay for the same reason).

The Columbus Dispatch reporter Dean Narciso asked the city's human resources director, Brian Dostanko, about the suspensions. Dostanko said the affair was consensual and happened off city time, but adultery is always considered conduct unbecoming in public-sector jobs. Both Emery and Myers are married.

Emery has been city administrator since 2011 and makes $119,828 a year. The city's form of government will change in January. Emery is expected to become the new city manager and will then answer to City Council.

Dostanko said Gore, who is Emery's boss, considered firing him but consulted with council members first, given the pending change. Gore then, with the council's support, issued the suspension.

Emery, who came to Marysville after a long career with the city of Gahanna, told Narciso on Wednesday that he had made a mistake.

"I have received the consequences associated with that misstep," Emery said. "In all facets of today's society, people make mistakes, and I owned up to it."

Emery's suspension was longer than Myers' because of his position with the city, Dostanko said.

"When you're higher up in authority, you should have a higher responsibility in curtailing this kind of behavior."

Myers, whose salary is $74,747 a year, served her five unpaid days in July.
